Cirque De Celebrite

Voting Terms and Conditions

1. The Cirque de Celebrite vote is organised by or on behalf of BSkyB Limited of Grant Way, Isleworth, Middlesex, TW7 5QD ("BSkyB"). If you have any problems with this service, or other enquiries, you can contact us on 08702 40 40 40.

2. Telephone voting is only open to residents of the United Kingdom. Residents of the Republic of Ireland can vote using the interactive red button on Sky digital. Voting signifies acceptance of these Terms and Conditions.

3. You may cast your vote by the following methods: premium rate telephone vote or interactive red button vote using your Sky remote control and Sky set top box. There are no alternative voting methods.

4. Vote lines open and close as advertised on the Sky One programme 'Cirque de Celebrite'. You may vote as many times as you like.

5. The public voting, telephone and interactive red button, combined with judges scores will define the contestant’s positions on the leader board. Once the public voting mechanisms are closed, the public votes will be collated and counted. The host will then reveal which two celebrities have received the lowest number of public votes.

6. The two celebrities with the lowest number of votes will then face the Judging Panel. The Judging Panel will take a vote on which of those two competitors will be saved to participate in the next show and which will be eliminated from the competition.

7. A competitor will be deemed to have been saved if a simple majority of the panel decide that they should remain in the competition. In the event of a tie, a casting vote will be held by the "head Judge", as nominated by the show's producer. The competitor who is not saved by the judges will be eliminated from the competition. For this week only {week 4. Sunday 28th Oct 2007} there will be a double elimination. Viewers voting is as normal. But, the three contestants with the lowest votes will face the judges. Firstly the three judges will vote to send home one contestant and then they will vote to save a second, sending the the third contestant home.

8. BSkyB reserves the right to reintroduce previously eliminated contestants, introduce a new contestant or make amendments to the competition rules should one of the competitors be injured.

9. In the event that technical or equipment failure means that public votes cannot be processed, the judges’ scores for each performance will be used to determine the scoreboard positions of each of the competitors. The two competitors with the lowest scores will then face elimination. The judges will then decide on which competitor they would like to save for the following show.

10. In the event of technical failure of the telephone or red-button voting systems, all BSkyB profits from the votes cast in the relevant show will be donated to the Charity Fit For Sport Foundation (Registered charity No. 1118546). BSkyB will not offer a refund for any votes cast where a contestant subsequently leaves Cirque de Celebrite voluntarily or through injury, or for any misdialled calls.

11. Should a competitor be forced to withdraw due to injury or illness (as verified by a registered medical professional) they will be given a one week "stay" allowing them to miss their Sunday performance while remaining in the competition. If the competitor is unable to take part in more than one show, then the competitor will be deemed to have withdrawn from the competition.

12. A "Stay" will not be awarded beyond the sixth weekly show. If a competitor is forced to withdraw from participation beyond the 6th weekly show, they will be judged to have withdrawn from the competition.

13. If a competitor is forced to withdraw from the competition then they will be replaced, following a consultation with the producer, and subject to availability, by a designated stand-by.

14. Replacement of a competitor by a stand-by will not happen if the competition has progressed beyond the sixth weekly show.

15. In the event of the substitution of a competitor by a stand-by, the stand-by will not face a public vote for their first show, and will not be subject to elimination in the same show.

16. In the event that the competition has progressed beyond the 6th show, and a competitor withdraws from the competition and a stand-in substitution is not made, the Producer, may (following consultation with the panel and Trainers) conduct the subsequent show without an elimination.

17. BSkyB reserves the right to discount votes if it has reasonable grounds to suspect that fraudulent bulk votes have been cast. That includes multiple votes made using technical enhancements and computerised or automated voting systems.

18. BSkyB may suspend, withdraw or re-set voting at its sole discretion. Sky One's decision in respect of the votes is final.

19. BSkyB reserves the right to amend these terms and conditions at any time for editorial, operational or other reasons.

20. If you are not the bill payer, you must get permission from the bill payer before voting.

21. At times, you may not be able to get through to register your vote. Sky One is not liable for callers or users not getting through, although you will not be charged unless your call is connected.

22. At least 10 pence from each vote cast will be donated to Charity Fit For Sport Foundation (Registered charity No. 1118546). For further information, contact: Fit For Sport ltd. 67a Hammersmith Road, Richmond Passage, London, W14 8UZ or visit www.ffsfoundation.com

23. BSkyB and its sub-contractors do not accept any responsibility whatsoever for any technical failure, or malfunction, or any other problem in any telephone network or line, system, server, provider or otherwise which may result in any vote being lost or not properly registered or recorded.
